Welcome to Infinitech Web.

These Terms and Conditions govern the use of our website, services, products, hosting services, website development services, domain services, maintenance services and any other services supplied by Infinitech Web.

By using our website, requesting a quotation, placing an order, purchasing a service, approving a website project, subscribing to hosting or otherwise engaging Infinitech Web for services, you agree to be bound by these Terms and Conditions.

If you do not agree with these Terms and Conditions, please do not use our services.


1. DEFINITIONS

For the purposes of these Terms and Conditions:

"Infinitech Web", "we", "us" or "our" means Infinitech Web and/or the applicable business entity operating the Infinitech Web website and providing the services.

"Client", "you" or "your" means the individual, business, company or organisation purchasing or using our services.

"Website" means the website located at www.infinitechweb.co.za, together with any associated websites, subdomains, applications or online services operated by Infinitech Web.

"Services" means any website design, website development, ecommerce development, hosting, domain registration, email, maintenance, support, SEO, digital services, consulting, graphic design or other services supplied by Infinitech Web.

"Project" means a website, online store, web application, design, development or other work commissioned by the Client.

"Third-Party Services" means services, software, platforms, plugins, themes, APIs, payment gateways, hosting infrastructure, domain registries, email providers, social media platforms or other services supplied or controlled by third parties.


2. GENERAL TERMS

2.1 These Terms and Conditions apply to all services supplied by Infinitech Web unless specifically agreed otherwise in writing.

2.2 A quotation, proposal, invoice, order, service agreement or written confirmation may contain additional terms applicable to a particular service.

2.3 Where there is a conflict between these Terms and Conditions and a specific written agreement signed or accepted by both parties, the specific agreement will take precedence to the extent of the conflict.

2.4 Infinitech Web reserves the right to update these Terms and Conditions from time to time. The latest version published on our website will apply to future services and orders.


3. QUOTATIONS AND PROPOSALS

3.1 Quotations are based on the requirements and information supplied by the Client at the time of quotation.

3.2 Unless otherwise stated, quotations are valid for the period specified on the quotation.

3.3 A quotation does not constitute acceptance of an order until the Client has accepted the quotation and any required deposit or initial payment has been received.

3.4 Additional work, functionality, revisions, integrations or requirements not included in the original quotation may be charged separately.

3.5 If the Client changes the project requirements after work has commenced, Infinitech Web may issue a revised quotation.

3.6 Estimated delivery dates are estimates and may change depending on the Client's response times, content delivery, approvals, third-party services and project complexity.


4. WEBSITE DESIGN AND DEVELOPMENT

4.1 Infinitech Web will develop websites according to the agreed project scope.

4.2 The Client is responsible for supplying accurate information, text, images, logos, product information, contact details and other content required for the website.

4.3 Infinitech Web is not responsible for delays caused by the Client's failure to supply required information, content, approvals or feedback.

4.4 Unless otherwise agreed, website development does not automatically include ongoing content creation, product entry, photography, copywriting, SEO campaigns, social media management or marketing services.

4.5 Websites will be developed using the technologies, platforms, themes, plugins and tools considered appropriate for the project.

4.6 Infinitech Web may recommend WordPress, WooCommerce, premium themes, plugins, hosting platforms or other technologies depending on the requirements of the project.

4.7 Certain functionality may depend on third-party software or services and cannot be guaranteed indefinitely.


5. CLIENT CONTENT AND MATERIALS

5.1 The Client confirms that they have the necessary rights, licences and permissions to use all content supplied to Infinitech Web.

5.2 This includes, but is not limited to:

  • Photographs

  • Videos

  • Logos

  • Text

  • Product descriptions

  • Graphics

  • Fonts

  • Documents

  • Music

  • Software

  • Trademarks

  • Copyrighted material

5.3 The Client indemnifies Infinitech Web against claims arising from the Client's unauthorised use of third-party material.

5.4 Infinitech Web may refuse to use content that it reasonably believes infringes copyright, trademarks, applicable law or the rights of another person or organisation.


6. DESIGN APPROVALS AND REVISIONS

6.1 The Client is responsible for reviewing and approving website designs, pages, content and functionality.

6.2 The number of revisions included in a project will depend on the quotation or agreed scope.

6.3 Additional revisions or substantial changes outside the agreed scope may be charged at Infinitech Web's applicable hourly or project rate.

6.4 Once the Client has approved a design, subsequent changes may be treated as additional work.

6.5 The Client remains responsible for checking the final website for spelling, pricing, contact details, product information and other content before launch.


7. WEBSITE LAUNCH

7.1 A website may be launched once the agreed development work has been completed and the Client has approved the website or the project has otherwise reached the agreed launch stage.

7.2 If the Client delays approval or does not respond to reasonable requests for approval, Infinitech Web may consider the project substantially completed and invoice outstanding amounts.

7.3 Infinitech Web is not responsible for delays caused by domain transfer, DNS changes, hosting providers, payment gateways, email providers or other third parties.


8. ECOMMERCE AND ONLINE STORES

8.1 Ecommerce websites may use platforms such as WooCommerce and third-party payment gateways.

8.2 Infinitech Web does not guarantee the performance, availability or uninterrupted operation of third-party payment gateways.

8.3 The Client is responsible for:

  • Product information

  • Product pricing

  • Stock levels

  • Delivery charges

  • Refund policies

  • Returns policies

  • Tax information

  • Payment gateway accounts

  • Customer communication

  • Compliance with applicable ecommerce laws

8.4 Payment gateway fees and transaction charges are charged by the applicable payment provider and are not included in Infinitech Web's fees unless specifically stated.

8.5 Infinitech Web is not responsible for payment failures, declined transactions, chargebacks, fraudulent transactions or disputes between the Client and its customers.


9. DOMAIN NAMES

9.1 Domain registrations are subject to the rules and policies of the applicable domain registry.

9.2 Registration of a domain does not guarantee permanent ownership of the domain.

9.3 The Client is responsible for ensuring that their chosen domain does not infringe another party's trademark, intellectual property or other legal rights.

9.4 Infinitech Web is not responsible for disputes relating to domain names where the dispute arises from the Client's choice or use of the domain.

9.5 Domain renewal fees are payable before the applicable renewal date.

9.6 Failure to pay domain renewal fees may result in suspension, expiry or loss of the domain.

9.7 Once a domain has expired, additional restoration or redemption fees may apply and may be payable by the Client.


10. WEB HOSTING

10.1 Hosting services are supplied according to the hosting package selected by the Client.

10.2 Hosting services may include website hosting, WordPress hosting, email, SSL, backups, security features, CDN services and other features depending on the selected package.

10.3 Hosting infrastructure may be supplied through third-party infrastructure providers.

10.4 Infinitech Web will make reasonable efforts to maintain hosting availability but cannot guarantee uninterrupted service.

10.5 Hosting may be temporarily unavailable because of:

    • Planned maintenance

    • Emergency maintenance

    • Server problems

    • Network problems

    • Cyberattacks

    • DDoS attacks

    • Software failures

    • Third-party infrastructure failures

    • DNS problems
